Terms and Conditions (T&Cs)

These Terms and Conditions set out the rights and obligations of Switzerlandcitytours.com and its customers.

They apply, in the version in force at the time the contract is concluded, to all business relationships between Switzerlandcitytours.com and customers using its online booking platform.

Switzerlandcitytours.ch reserves the right to amend these Terms and Conditions at any time without prior notice.

Subject of the contract

The purpose of this contract is the provision of guided tour services in the Swiss cantons of Bern, Jura, Neuchâtel, Fribourg and Lucern.

Guided tours are generally designed for groups of up to 25 participants. This number may be adjusted with the prior agreement of Switzerlandcitytours.com, provided that doing so does not adversely affect the quality or smooth running of the tour.

Formation of the contract

By placing an order, the customer accepts these Terms and Conditions.

The contract between the customer and Switzerlandcitytours.com is concluded once the booking has been confirmed. The customer must promptly notify Switzerlandcitytours.com of any spelling mistakes, calculation errors, or discrepancies between the order and the booking confirmation.

To book a tour through the Switzerlandcitytours.com online platform, customers must either register as a customer or proceed as a guest. Switzerlandcitytours.com reserves the right to revoke such access at any time.

Any terms and conditions of the customer that conflict with these Terms and Conditions shall not apply unless Switzerlandcitytours.com has expressly agreed to them in writing.

Payment

Payment for guided tours must be made through the online booking platform.

All prices are stated in Swiss francs (CHF) and include Swiss value added tax (VAT) at the applicable statutory rate. Contracts and invoices are issued in Swiss francs.

Prices may change from time to time. However, the applicable price is the one displayed by Switzerlandcitytours.com at the time the booking is placed.

Payment is due immediately upon conclusion of the contract.

Changes and Cancellation of a Booking

    • Up to one week before the scheduled start of the tour: free of charge, excluding any non-refundable costs already incurred by Switzerlandcitytours.com in connection with the organization of the tour, including, but not limited to, public or private transportation for the guide or the group, admission tickets, and similar expenses.
    • Less than 72 hours before the scheduled start of the tour: 100% of the tour price will be charged.
    • Cancellation requests must be sent by email to info@switzerlandcitytours.com.

Customer delay

    • Delay of less than 30 minutes: the tour will be shortened by the duration of the delay at no additional charge. If the guide’s schedule permits, the tour may be extended. Any additional time will be charged at a rate of CHF 100 per hour, calculated on a pro-rata basis.
    • Delay of more than 30 minutes: the tour will be cancelled without refund. Any extension or rescheduled tour will be charged at the full tour price.

Delay of the guide

  • Delay of less than 30 minutes: the tour price will be reduced proportionally. If the guide’s schedule permits, the tour may be extended at no additional cost.
  • Delay of more than 30 minutes: the customer is entitled to cancel the tour and receive a full refund.

Traffic delays, public transport delays or illness 

Customers must inform Switzerlandcitytours.com immediately if they are delayed. Every reasonable effort will be made to find an appropriate solution on site. Otherwise, the cancellation policy shall apply.

If the guide is delayed, the guide shall immediately inform the customer and propose an appropriate solution. Otherwise, the cancellation policy shall apply.

Participation in guided tours

Participation in guided tours organized by Switzerlandcitytours.com is entirely at the participants’ own risk. Participants are responsible for arranging their own accident insurance, theft insurance, and personal liability insurance. Customers are also liable for any damage caused by themselves.

The guide reserves the right to refuse or terminate a tour if a customer violates the law or behaves in a manner that is inconsistent with the values upheld by Switzerlandcitytours.com, namely respect for the place and its historical heritage, tolerance, mutual respect, and non-discrimination. The same applies where one or more customers disrupt the proper conduct of the tour.

Foverning law and jurisdiction

These Terms and Conditions shall be governed exclusively by Swiss law.

Any dispute relating to the validity, interpretation, performance, non-performance, suspension, or termination of this contract shall be subject to the exclusive jurisdiction of the competent courts of the Canton of Bern, where Switzerlandcitytours.com has its registered office, in accordance with the Swiss Code of Civil Procedure (Title 2, Articles 9–46).

Before commencing legal proceedings, both parties undertake, in good faith, to make every reasonable effort to resolve any dispute amicably.
